Terms of Service

These Terms of Service (“Terms”) govern engagements between VoipArchitects (“we,” “us”) and the client (“you”) for the deployment, configuration, and support of open-source telecommunications software. By requesting a quote or engaging our services, you agree to these Terms.

1. Scope of services

We provide professional installation, configuration, integration, hardening, and optional ongoing support of open-source telecom platforms including Asterisk, FreeSWITCH, FusionPBX, MagnusBilling, and Vicidial. Each engagement is defined by a written scope and fixed quote agreed before work begins. Anything outside that written scope is treated as a change request.

2. We are an independent services provider

VoipArchitects is not affiliated with, endorsed by, or sponsored by the projects or vendors behind Asterisk, FreeSWITCH, FusionPBX, MagnusBilling, or Vicidial. All product names and trademarks are the property of their respective owners. We provide integration and configuration services around this software; we do not resell it or claim ownership of it.

3. Client compliance responsibilities

You are solely responsible for how your telecom system is used and for compliance with all applicable laws and regulations in every jurisdiction you operate in. This includes, without limitation:

  • Telemarketing, robocall, and auto-dialer rules (for example the TCPA, TSR, Ofcom rules, and equivalent local regulations) for any Vicidial or outbound-dialing deployment.
  • Consent, do-not-call list scrubbing, calling-hours restrictions, and accurate caller ID / CLI presentation.
  • Lawful billing, taxation, and rating of VoIP traffic for any MagnusBilling or reseller deployment.
  • Lawful interception, call recording, and data-retention obligations.

We configure systems to your specification and can advise on technical controls that support compliance, but we do not provide legal advice and we are not responsible for how you operate the platform after handover. We do not knowingly assist with fraudulent, deceptive, or unlawful calling or billing operations, and we may decline or terminate any engagement we reasonably believe is intended for such use.

4. Access and cooperation

You are responsible for providing timely access to servers, SIP trunks, DNS, credentials, and any third-party accounts required to complete the work, as well as a designated technical contact. Delays caused by lack of access may affect timelines.

5. Fees and payment

Fees are as stated in your written quote. Fixed-scope project fees and recurring support retainers are billed as specified in that quote. Recurring support may be paused or terminated with the notice period stated in your agreement.

6. Warranty and support

We warrant that services will be performed in a professional and workmanlike manner. Because the software is open source and runs in environments we do not exclusively control, we do not warrant uninterrupted or error-free operation. Post-deployment issues are handled under the terms of your support retainer, if any.

7. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to an engagement is limited to the fees paid for that engagement. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost revenue, regulatory fines, or telecom fraud losses.

8. Confidentiality

Each party will protect the other’s non-public information disclosed during an engagement and use it only to perform or receive the services.

9. Changes to these Terms

We may update these Terms from time to time. The version in effect when your engagement is agreed governs that engagement.
